Good points. Moreover, before the judge "found" microsoft to be a monopoly etc etc, the justice dept was basically saying that they are not going to break up a "great company" like microsoft (I remember "anonymous" sources being quoted in newspaper stories). While this may have been wrong speculation, it is possible to think that Microsoft may have never dreamed that the govt could ask for a breakup - given their belief that they haven't done anything wrong and the govt is making a mountain out of a mole hill. So, they should be given the opportunity to argue against a breakup.

However, this judge has proven himself to be biased, so, can't expect ANYTHING rational, reasonable out of him.
