It looks to me like the posturing of Jackson and the DOJ right now is an attempt to first invite some kind of settlement that will allow their ruling to stand with less ridiculous remedies or, optionally, a supreme court fast track that avoids the high probability of a quick, appellate court slap down.

It's amazing to me that such a clear Kangaroo process can be allowed to continue in spite of a continuous stream of biased behavior on both the judge's part and questionable involvement of some competitors that must be an embarrassment for many ethical legal professionals.

Jackson's response to questions about the refusal to hear both sides on the new issues introduced by the DOJ in the remedy phase was "did the Japanese get to negotiate the terms of their surrender?" This alone makes his bias crystal clear. In addition to the cost to taxpayers both in the case and the potential higher costs and regulation of software, I wonder what other injustices this guy has wrought in less public cases.

As far as the anti-Microsoft vultures that appear in droves whenever they see their beloved Unix enclaves with a chance to eliminate or cripple Microsoft as a choice for consumers, enjoy this moment while it lasts. I believe it will be the best you get.
