johnd--There won't be any witnesses. Each side will prepare a written brief and have about one hour to argue which conclusions of TPJ were arbitrary or capricious. There will be no review of findings of fact such as which witnesses were believable. The judges's findings in that regard are binding and not appealable. This in one of the many reasons why MSFT's belief that this appeal is a slam dunk are way off. I bet that most of the oral arguments will focus on which remedy is correct, not whether there is a monopoly or illegal practices. That horse is out of the barn.
