"the crowd that bets litigation" could and should be extremely small in the reality of the current situation.

If you want to sue me over a seat-belt patent,for example, it won't stop the car manufacturer from selling cars. You simply get your pound of flesh if and when you win, perhaps several years down the road. But if you want to fight the Q's massive patent position and court record, how many operators will you sign up as you vigorously battle the windmill?
