You can take a gain at any time, but you can't re-buy to prevent the gain. (As I understand it.) Philosophically, the IRS works this way....if there's a situation where you MIGHT have to pay taxes, you pay them, and if there's a situation where you might not have to pay taxes, you STILL have to pay them.
