I am not happy with one of my trade with datek this morning. Anybody has any suggestion what I can do about it?

I entered a stop market order to buy 200 shares of MSTR on 09:34:06 at stop price of $37. The order was activated at 09:35:30 according to datek. 133 shares were filled at 09:36:33 at $38 1/8 and 67 shares were filled at 09:37:58 at $38 31/64.

I called datek service representative. He told me the bid stayed $37.25 for 4 seconds, and 37.5 for 20 seconds, but insisted that was a valid fill since the order was filled within 3 minutes. He said he cannot do anything about the transaction since it is up to the market maker to fill the order. Datek has no control at time and price where the orders were filled.
