By the way, I think you must mean the "offer stayed...." not,

Because you were buying on the offer, not bidding as I understand your problem.

It's a lot easier to try those trades on the NYSE or even ib the Futures pits. I think on NASD it's a hit-and-miss situation. If they ticked your price then ran up right away...it happens...then it's difficult to posture a case.

That 3 minute stuff is for the birds, I think. It just allows them an out. It's my guess that you just weren't lucky with that one...

Just my thoughts on it, however.
