Well, I guess the BREAKING NEWS (CNBC) explains why MSFT did that 2nd filing. If the Supreme Court does not hear this case, it is DOA at the US court of appeals, IMHO. They are getting angry (appeals court judges). Such a fast decision to hear MSFT's appeal. BTW--Requesting fast track to the Supreme Court might have been the DOJ's dumbest move in fighting this case. One bad move and they could be in trouble. I bet Klein is now praying the Supreme Court accepts the case. Like I said we have some angry judges who will overlook the "facts" just to get back at Jackson for implying they were incompetent. IMHO, this is the best scenario for MSFT. The Supreme Court may be neutral but the Appeals court judges "appear" to be leaning in MSFT's favor. MSFT could actually win at the high court but there is no doubt they will win at the appeals court if it goes that route,IMHO.
