Charles - pretty deep reading of the tea leaves. I don't think the appeals court is a pushover for anyone, and MSFT will certainly have their work cut out for them. But the increasingly desperate moves by the DOJ indicate that they, at least, believe that they have good reason to want to avoid the court of appeals.

However, the real motivation for most of the people involved in the DOJ and state cases has been served - Bois can now charge $700 an hour and is assured of good gigs well into the future, the state attorneys general have had their name in lights and can move to higher office with better name recognition, and Judge Jackson is assured a place in legal history. Only the MSFT competitors need to see this case affirmed.

Maybe I am getting a little cynical in my old age...
