The NYT, being in general ironic rather than blatantly sarcastic, left out the "for the billionth time". Of course, the NYT gets cited in Microsoft's motion, so they must count for something. Anyway, one little bit for you, Jerry, out of context, it's hard to say how relevant it is.

Almost as soon as the appeals court received Microsoft's brief, the judges issued a remarkable order saying the entire court, minus three judges who recused themselves, would hear the case "in view of its exceptional importance."

That looks like official appeals court spin to me. How that spin plays out in the face of the Expediting Act is a conundrum, I guess they could claim it was exceptionally important, but not that exceptionally important.
