Correct. This is highly unusual. The appeals court normally will accept the findings of fact as is. Not this time though. The reason is that MSFT has claimed procedural error and factual inaccuracy on Jackson's part. Jackson failed his job from a procedural and an accuracy standpoint. The appeals court knows this is probable and will agree to review the 'findings of fact'.
