It's not unusual for judges to choose between alternatives presented to them rather than necessarily coming up with original remedies; in fact, I think it might be objectionable if a judge WERE to "innovate" in the area of remedies, since then the litigants could rightfully claim they had not had an opportunity to respond to the proposal. JMHO.
