I did answer your question. If you're going to play this amateurish game of whose patent is on first, then you better pay attention to details like corporate history and people's lifework.

IDC acquired SCS in 1992 to combine its TDMA technology with SCS' broadband CDMA technology. Some of IDC's patents are still listed under SCS and International Mobile Machines, IDC's original corporate name.

Schilling's spread spectrum paper trail and patent production over 40 years give you an idea of the breadth and depth of his groundbreaking work on spread spectrum (trademarked as BCDMA) which preceded and then became a competitive parallel to the narrowband CDMA that Qualcomm commercialized in the limited spectrum that was available in the early 90s.

And because you seem to be the excitable type, keep in mind that a patent does not confer ownership over a technology. It only gives the inventor the right to EXCLUDE others from using his invention for a limited period of time before it becomes part of the public domain.

That's why QCOM is currently making a lot of money with 2G CDMAOne, BUT 3G WCDMA is an entirely different enchillada altogether because it is designed to be a hybrid of sorts between the TDMA/GSM de facto global standard and broadband CDMA, which is being hashed out vigorously in open source fashion at the 3GPP.

That requires TDMA IPRs and CDMA IPRs. QCOM only has CDMA IPRs so they have to deal for TDMA IPRs. IDCC has TDMA and CDMA IPRs, in FDD and TDD. And only 56 million shares outstanding.
