One must go back even further to understand why AZNT ever filed the lawsuit in the first place. The company's decision to file the suit in the wrong jurisdiction appeared to me immediately that they did not consider the suit seriously. There never was any doubt about case law regarding this, and in fact their very weak attempt at justification with the use of case law was the same case law that we successfully referred to which proved that the case could not be heard in LV. There was no confusion over the understanding of the law on our part, nor should there have been for them.
This was not in reality an AZNT lawsuit, but instead, a malicious lawsuit based on payback filed on behalf of those promoting the lawsuit, IMO.
Why do I believe they were not serious and were only trying to hurt us? One does not file a lawsuit based on bogus information, nor for an unacceptable amount of $250,000,000. Can you imagine that argument in the courtroom? That was for headlines and had absolutely nothing to do with merit. What a shame it took up valuable court time. Until something good came out of it...

BTW, I stand by by sworn affidavit and have never spoken to Mike Sylver, Robert Qualey, nor ever harrassed any AZNT employee. Why did he claim that I had at the last minute? Why had he done something similar in a previous case and what was the outcome of that assertion? |
