My point is that Q has a soft-handoff patent whose technology has been commercialized. I believe it is probably applicable to WCDMA soft handoffs if the WCDMA standards use such a handoff. Can I prove it? Of course not, and you cannot prove the obverse either. Only a judgment from a court will do so with any finality. I don't have access to WCDMA standards for handoffs but I do doubt that they will specify handoffs in such a manner so as to exclude Q's soft handoff technology. If you have copies of the standards, let me see them. I'll gladly tell you that you're right if it is justified.

On the other hand, IDCC seems to have a patent whose applications (unlike the Q's) are untested, uncommercialized and unproven. At first glance, IDCC's patent appears derivative of Q's patent and therefore potentially infringing. But I'm no patent lawyer (and neither are you) so our speculation is really irrelevant. I do believe that Dr. J. thinks that the Q's soft handoff patent applies to WCDMA. I'll take his word for it. Can you with any certainty say that IDCC's patent has been adopted wholesale by the WCDMA standard setters? Or that they have acted in a manner calculated to exclude Q's handoff patents? If so, let me have some proof.

I agree that you are correct in the rest of your answers to your own questions. Your point escapes me, however.
