Always good to read the fine print there, OverSold. An appropriate title for the headlines, actually.


But it will likely prove to be a Pyrrhic
victory. The last paragraph of the
two-page order says: "In the event that
the District Court certifies the appeal"
to the Supreme Court under the
Expediting Act, "this briefing schedule
will be automatically suspended."

That certification is likely to come
within the next 24 hours, and as a
result the government proclaimed
victory, too. In a statement, Justice
Department spokeswoman Gina
Talamona said: "We are very pleased
with the court's ruling that it would stay
further proceedings if the District Court
certifies the case for direct appeal to
the Supreme Court."
