No. both sides think they have the winning answer though CALP seems to be taking the higher ground (and is therefore probably the winner). Nevertheless, my experience is that if it goes to jury, the dirty players can often win.

Thats the easy answer. Does it matter? Probably not. By the time that things get sorted out, the technologies will have all moved forward.

My greater concern is the relative simplicity of the " Lab on a Chip" product by CALP. I'm hoping to see RT-PCR (detects RNA products), or PCR (detects DNA and DNA mutations), or better yet RNAase protection assay or Southern or Northern assays. I'm not sure what I would use the current DNA size sorting for, maybe its kind of like a Southern. If someone figures out how to do some of the other techniques, they could easily leap frog CALP. If CALP figures out how to do it first, they will win with essentially no competition able to catch up.
