The claim is trademark infringement & Sun has already
prevailed in keeping M$FT from displaying the java
logo on its implementation of java. There is no
dispute about that.

As you will remember, if you can, M$FT was forced to
change the code back so that it was in compliance, and
they did so. That was the point of the suit: to keep
java from being made into a proprietary Java tied to
Windows.

M$FT got caught red handed in their attempt to pirate
jvm. That's why there are certification tests and
that's why M$FT failed the tests.
