David--A monopoly doesn't mean 100% market share. I think some monopolies have been found with market shares of 65% or so. Usually 80% market share will meet the monopoly definition and always a 90% market share will be found to be a monopoly. Once you understand the case law, it is clear why that part of the case was a slam dunk. Even counting the Mac OS, which TPJ inexplicably did not, MSFT has a monopoly in the OS market. BTW, as James Bowers points out, Alcoa was a 2nd Circuit Court of Appeals case, written by the great Judge Learned Hand, not a Supreme Court case.
