James--You are discussing what the law should be. I am discussing what the law currently is. Maybe Alcoa is bad law, but until it is overturned, it is current law. Let me ask you a few questions. If you had been advising MSFT prior to the DOJ lawsuit and during it, would you have let them know the current understanding of the market share that leads to a monopoly finding? Would you have advised them to keep adding applications and features to their OS? I don't think so. It's fine to get on the soap box and talk about how we should change the laws, but until they are changed, why not comply with the current ones. We all lost when Bill G failed to comprehend this. He still thinks that the law makes no sense and that he is therefore free to ignore it. BTW, thanks for the correct Alcoa cite. Mea culpa.
