The thing about the death penalty is that if you screw up you don't have a second chance (unless your in Florida I guess).

The biggest problem is that it negates the argument that killing is wrong. It becomes who gets to kill, how pre-meditated does it have to be before it's legitimate, and how much abuse are you allowed to heap on the victim before they are killed.

It's not much of a deterrent, otherwise we wouldn't have all these murderers waiting in line for their needles. It only seems a deterent to those not inclined to get themselves into that situation anyway.

It's used as a sideshow after the fact. There's something fundamentally wrong with waiting for crimes to happen and then using maximum penalty and not expending more effort to stop the crimes in the first place. (Like making the guy's handgun a bit harder to get in the first place).
