If this society was truly rational and advanced, a death penalty would not be an option. The death penalty is actually worse than murder because it is always pre-meditated and it is always murder in the name of the State. Who is the State? No one, anyone, a faceless mass. It is not done in the name of an individual, but a faceless mass, or mob, if you will.
