I believe the people of the individual States are free to decide the question of Criminal Law and Penalties within their borders and that the Federal government ( like King G of E ) should keep it's nose out of it. Whether or not breaking the very few Federal crimes authorized by the Constitution should subject you to the ultimate penalty, we can discuss. Not many traitors have been executed in the last 50 years so it's not that pressing an issue.
