Note that, as the filing correctly cites, it was Dell's misbehavior in a similar setting that created the precedent for Hitachi's countersuit. And, gee, heard that BT owns hyperlinks? While Rambus's behavior is aggressive, it may have been within the rules of the game, laxly interpreted. In current IP law, I think we're watching the slow trainwreck of a prisoner's dilemma in action. I cannot believe any semi stock besides Rambus rallied on the settlements, yet the whole sector did.
