I have looked at it a bit, and I have to say it's a coin toss as far as I am concerned. No clue which way things will be ruled. The whole patent office business has become an awful mess these days. It's gone the way of the rubber stamp if you ask me. Still cutting staff in the patent office, and more and more applications flooding in. What's a bureaucrat to do? Say, "Sure! Fight it in court!" to anybody who looks decent coming over the transom.

viz. The Amazon, one click shopping patent. How ridiculous can you get! Idiotic.

So, I don't know. Personally, I rather suspect that the ruling should have gone for VISX in the case they just lost. But one also has to deal with the fact that those who review these in the courts are usually not particularly specialized in technology.
