I believe INTEL already has an ITC action against VIA to be completed early next year.(if I recall correctly)

Good point. Via hasn't backed down from the Intel legal action; Rambus better have all the ammunition it can muster before initiating legal action against Via. Remember, Via has deep, deep pockets.
