If you want to use the term in an enforcement sense, then yes you do have to wait, although I suspect that few victims or victims families do. A felony is different, though. A felnoy is the most serious form a crime can take. There are added elemets to felonies that misdemenaors lack. Intent is one example. Each of these elements must be proven for a felony to have been committed. An example that would probably surprise you is the felony murder rule. Here is how it occasionally comes into play.

A and B rob 1st Bank. A and B get into a shootout with the police. Cop X shoots at A and kills him. Person B can be charged with A's death because a police officer shot and killed A while B was committing a felony. Of course, the state must prove that a felony was being committed and the death of A was the result of that felony's commision. Please feel free to correct any oversights, Zooty, as it has been a long time since I have studied the FMR.
