During the period of time that the death penalty did not exist (before it was re-instated by the Supreme Court), the statistics show no significant increase in the murder rate... so your arguments that murder rates will go up are unfounded speculation.

Say that you agree to an experiment where you are given a .44 revolver handgun which has been engineered not to fire. The engineering is a bit flawed, however, and there is no 100% guarantee that it might not go off. Now you are instructed to point the loaded pistol, at point-blank range, and aim it directly between the eyes of each person who stands in front of you, squeeze the trigger, and let the hammer fall. There are 100 people so you must do this 100 times.

Question: How sure are you that, at the end of the experiment, every one of those 100 people will still be alive?
