Blake,

We will be getting a big dose of this kind of propaganda in the coming weeks. It is public posturing. These memory and chipset foundries have a small window of time left in which to conclude their business with RAMBUS. We should see a resolution of this matter between now and the launch of the P4 platforms. Failure to license the patents leaves their OEM business fair game the licensed companies.

These companies are not likely to sue RAMBUS because it is a "bet your company strategy." RAMBUS does not have to license hostile infringers. Recall that RAMBUS informed Hitachi that it would not license them if the lawsuit went the distance. In the meantime, such lawsuit will discourage the OEMS from doing business with potentially infringing companies. Why buy from Micron when you can buy from a licensed company? Also, the OEM products which include infringing SDRAM, DDR SDRAM, DDR SGRAM or RDRAM can be blocked from access to the US market. Add to that the potential for treble damages for willful infringement and you have a witches brew of trouble for the infringers.
It is as I said a bet your company strategy.

Simply put, the stakes are too high for infringing companies. IMO we will see a new round of license in the near future.

:)
