No need to take my comments at face value; find a copy of the immigration law and look it up for yourself. The law is a public thing.

The boy may not have been in physical danger, but I'm not sure that spending his life as a political pawn for the CANF was exactly good for him.

Do you really think the CANF would have turned the boy over if an unnecessary court order had been issued? They had already defied the INS, which has all the necessary legal authority to order them to turn Elian over. I thought it was pretty clear that they wanted a confrontation, wanted to ring the house with protestors and force the government to back down or hurt somebody, make a big media event of it. This would of course have been every bit as traumatic for Elian as the raid - likely more so, as it would have dragged on - but I see no reason to suppose that Elian's welfare was ever high on the CANF agenda.

To the extent that the timing of the raid avoided this kind of scene, it was probably a smart move. My only real objection is the egregious display of firearms, which I think was unnecessary. However, it was completed quickly and nobody was hurt, so I'm not sure I should be second-guessing the commander on the ground, who might very well have had information that I don't.
