Steven, immigration law as it relates to the INS has its limits. For instance, the INS cannot detonate a nuclear warhead in an effort to catch an illegal alien. Why do you refuse to recognize some limits of INS action exist? The INS should get a court order to transfer custody of a child.

The emotional belief that the CANF would do anything, including grossly illegal actions, to keep custody of Elian is an assumption based primarily on media propaganda. The protestors were not killers. Protesting is legal, it's part of our first amendment rights. Using your justification for level of INS action could lead to all kinds of brutalities, such as the Clinton/RENO killings fields of WACO.

The justice department and INS have an obligation to treat law abiding Americans in a way which is in alignment with the principles of the constitution. To due otherwise is to relegate our country to two-bit dictator police force status.

The timing of the event as a way to diffuse tension and achieve the objective was pathetic. Simply look at the consternation it has caused on this board and in Southern Florida in order to determine that.

No, I don't guess you want to take a hard look and second guess something you have supported on this board so vociferously. That's a fairly common defense reaction.

The fact is the INS gave temporary custody to the Miami relatives. If a mistake was made, (regarding parental fitness) it was made by the INS in their initial decision.

Getting a court order and presenting it to the family is really not that difficult a thing to do when you're the President of the United States or Janet Reno. (Providing of course the law is on your side). Obviously, it was up in the air somewhat and legal decisions were still pending. Acting (because they couldn't obtain a court order) before legal decisions have been made, does not follow the spirit or intent of our civil rights under the fourth amendment. The comment..

"They cannot see beyond that fact that the issue is no longer "where does Elian belong" the issue is "do we follow the rule of law, or do we let our frustration with the court process sanction extreme force, by executive privilege?"

Is therefore right on the money!
