No, the INS is not entitled to detonate a nuclear bomb in pursuit of an illegal alien. It is entitled to grant and to revoke parole, to order the turnover of an illegal alien, and to enforce that order. You may feel that a supplemental court order would have been desirable, but it is in no way legally necessary.

The emotional belief that the CANF would do anything, including grossly illegal actions, to keep custody of Elian
is an assumption based primarily on media propaganda.


It is based on public statements by Cuban-American leaders, in which they proclaimed their intention to retain Elian no matter what the government did. Protesting is not illegal. Preventing the INS from taking custody of an illegal alien is.

A lot of people were expecting that the situation would end up with a ring of protestors around the house, and government agents faced with the choice between backing down and forcing their way in. This could have gone on for days, which the CANF would have loved, though it would hardly have been beneficial to Elian. To the extent that the timing of the raid preempted such actions, it was well timed.
