If a mistake was made, (regarding parental fitness) it was made by the INS in their initial decision.
Michael-- I just noticed this statement of yours and have to ask-
Are you sure the initial granting of temporary custody was based on "parental fitness"? I have never seen that alleged. There was no parent available to take custody and TEMPORARY placement with the MIami Cubans was a logical step for the INS to take, one that was in the best interests of Elian at the time, You seem to forget that this was a temporary placement- of the type that is often made until facts can be sorted. I don't think I have EVER read that this was done on the basis of Juan's lack of fitness! At the time, the facts surrounding Elian were still very vague and unverified.
As for court order to transfer custody-- custody had been terminated. There was none to transfer. Elian was an illegal alien under INS jurisdiction, family court no longer had jurisdiction. THe relatives were holding Elian illegally by that point.
