The distinction, I believe, is that driving a car is not addictive, nor is driving into a brick wall. Although all smokers started off with a choice whether to smoke, the addictive properties of the product trump any element of choice. Fact is, they made a product they knew was addictive and killed people, tried to hide that fact, then lied about it.
