The statement you made in an earlier post that the initial decision by the administration to allow the issue to be handled in family was an "administrative error", or words to that effect looks pretty unlikely when you view the timeline of events.

Here in this report of November 30 the Herald wrote the following...

U.S. government officials said Monday they will play no part in deciding whether 5-year-old Elian Gonzalez, the survivor of a Thanksgiving week smuggling tragedy that killed his mother and nine others, should rejoin his father in Cuba or remain with relatives in Florida -- a question they said can be answered only in state courts.

Immigration officials said they, along with the Coast Guard, were following U.S. policy when they allowed Elian into the country out of concern for his health. That changed his feet from wet to dry under the migration accord, preventing his return to Cuba.

As a result, Elian will be paroled into the country Dec. 23, and the question of his custody will be a matter for Miami-Dade family court.


Then fully a week later the INS made this statement...

''It's the migration accord that allows him to remain in the United States for the short term,'' INS spokesman Russ Bergeron said. ''And it's the Cuban Adjustment Act that allows him to adjust his status for the long term.''

That evening Castro made his threats and the administration changed its tune the next day. "Ooops", doesn't seem like the most plausible scenario to me Steven.
