I have smoked in the past and, luckily, never became addicted. My wife smokes, and I'd have to say is quite addicted. She spends enough on cigarettes each year to pay for a modest vacation. My mother, one of my sisters and one of my brothers are all addicted. I'm sure they all started out knowing that smoking was bad for them, but they quickly became addictive.

The tobacco addiction is insidious. Traditional notions of contributory negligence can't be used in the case of a product like this, particularly when the evidence (after years and years of long, drawn out litigation in which the tobacco industry has stonewalled, obfuscated and hidden and destroyed evidence) has finally established the complicity of the industry in trying to enhance the addictive properties of cigarettes. I have no doubt the industry made a conscious choice to target young people, to ensure a continued supply of users to replace those who die due to cancer and other smoking-related diseases.

The evidence is in, and a jury that heard that evidence decided it was sufficiently egregious that the industry needs to be punished. That is the role of punitive damages - punishment and deterrence. Frankly, I don't care much if RJR, Lorillard and Phillip Morris are driven to bankruptcy or worse. I'd like to see their top management indicted for perjury and obstruction of justice.
