Rockwell unit sues JDS Uniphase over chip patent

WILMINGTON, Del, July 18 (Reuters) - Rockwell International Corp.'s (NYSE:ROK - news)
patent arm, Rockwell Technologies LLC, has sued JDS Uniphase Corp. (NasdaqNM:JDSU -
news) for alleged infringement of a Rockwell process patent for making semiconductors,
according to papers filed late Monday in the U.S. District Court in Delaware.

At issue is a patent issued in 1983 for an ``Epitaxial composite and a method of making.'' The process, referred to as Metal
Organic Vapour Deposition (MOCVD), is related to the manufacture of semiconductors.

In court papers, Rockwell Technologies, of Thousand Oaks, California, said it believes JDS infringed the patent by allegedly using
its MOCVD process to make MOCVD wafers and import them for sale into the U.S. while the patent was in effect.

JDS makes components for fiber optic communications. Last week the company said it had agreed to buy its competitor, SDL, Inc.

Rockwell seeks a jury trial on its claims for damages. No one at JDS' offices in San Jose, California, was available for comment
early Tuesday.
