MSFT is already on notice about expansionism. They can't afford any overt moves because all authorities are on the watch for them. They can forget subtle ones too where control is implied.

Malone is a loose cannon trying to find a place to belong. Nothing he attempts at this point will come to fruition. He's too deep in concession and so isn't in a place where the value of independent action can come to him.
