The INS is entitled to make exceptions. Asylum laws cite specific danger of political persecution as grounds for exception (the danger must be specific to the individual; the mere existance of political persecution in the country of origin is not enough), there may be other grounds cited as well. I'll have to ask around the neighborhood; Filipinos are appallingly knowledgeable about US immigration law.

Obviously, there will always be judgment involved.
