Granted not their 'fault'.

In a legal sense, and a practical one for that matter, "fault" is determined by judgement and results in a righting of a wrong, in such a way that the end result negates the "wrong". All of this at the expense of the "one" who is "at fault".

By extension, and in the purest sense, one always knows who is at fault by observing who paid the "tab" for the particular "wrong" that was committed. The question that should be asked of any "wronged" business is, "If it wasn't your fault, why did you pay the judgement to right the wrong?"
