Such boasting could mean libel suit for DEC. While in most states, there is a "litigation privilege" that protects allegations in a legal suit, there is no such protection for trade libel. DEC may try to couch it in the protection afforded to litigants by connecting it, but if they are wrong and Intel can prove injury to its reputation in the market (one that they spend billions of dollars on) then DEC may be screwed.
