We are NOT all equal- the question is should the law ignore that?

The law has never accepted that all people are equal. For example- diminished mental capacity has always been considered relevant, well I know it has at least as far back as English Common Law. Minors are treated differently too.

Who the law unequally protects or inconveniences is a function of who is in power and what they wish to do. Since men are not impartial and men enforce the laws the laws never can be impartial. Perhaps as written they might SEEM impartial- if everyone were the same, but of course everyone isn't. People who enforce the laws can try to be impartial- but that's the best they can do. We all have our biases. Even those of us who know we have them still have them.
