The previous FCC OVS exercise would tend to support your statement because it was primarily directed at the ILECs who wanted to do SDV at the time, if my memory serves me right. But today the MSOs are equally capable of "switching", although they may do it under the banner of "routing" via IP.

This could become another semantic exercise for the courts to decide, since the two service venues continue to morph far beyond the definitions of service that prevailed when the regulations we are talking about were written. What do you think?
