The issue with Gemstar is that its founder & inventor of its core technology, Dr. Henry Yuen, who originally trademarked as "VCR Plus" that enabled simple VCR programming by the entry of numerical codes provided in the weekly newspaper TV guide, is not only an CalTech engineer, but also a registered patent attorney. I am familiar with Dr. Yuen as he his one of the more accomplished alumni of my law school outside the practice of law.

What I have been able to gather is that Dr. Yuen, having an obviously solid foundation in the technology of his invention(s), he is also just as versed in the potential scope of patent rights attainable in the prosecution of a patent that lays claim to such rights. I think the record shows that Dr. Yuen is a dangerous man in the eyes of his competitors.

I am sure there is more to GMST's "grid" patent that appears on its face. Sometimes, patents just need to be challenged. The question is which one. A patent does not grant the owner an absolute right to the technology, but more appropriately the right to sue to defend a claim based upon a presumption granted by the PTO. The point to be made is that Dr. Yuen is a proven master at this legal game. I'm a sure that many a patent attorney has perused many of GMST's patents, looking for a "hole" with which to challenge the scope of GMST's rights. But to date, no one has been successful.
