Actually there was a rather imporant reference to the merger when Josef talked about the need for higher powered 40 gig systems. He said their own (tranceivers?)were going into customer labs with an estimated time to revenues of 12 to 18 months. [An ice-age in product cycle time.]

I think there are some critical product gaps that give the merger credibility in terms of the DOJ. What's likely to happen if they nix the merger, how will they pick up the slack in time to gain a hold in the market for 40-gig (higher channel-count, higher power) products, and, more importantly, will their loss be as devastating as it was for LU when they miscalculated the OC-l92 market? If JDS can prove how important these products are, perhaps merger approval won't be as difficult as some fear.

Another indirect reference to the merger came when they discussed 50 gig filters. A question for those who understand filters, what's the market for 50 gig versus 100 and 200? There were several questions on the call and Jay said they can use interleaving to make a 50 out of a 100 and I don't have a clue what this means. What are the advantages of a pure 50 vs. a hybrid? He went on to say they were in development on 50 gig using AWGs, the filter technology now being shipped by SDL's PIRI division. If they're considerably behind SDL, then it's more fodder for DOJ process.

To block the merger would be to block innovation. Not exactly the DOJ's mandate.
