In reference to your questions:

Do the broad Rambus high speed DRAM patents cover Ramtron/EMS memories? Will
Ramtron have to pay royalties to Rambus?

Enhanced Memory Systems ESDRAM and HSDRAM products are supersets of the industry
standard SDRAM. Some people are suggesting that all SDRAM products violate specific
Rambus patents. We do not believe that the Rambus patents will be upheld in a court. We
would suggest that Toshiba and Hitachi settlements were motivated by unique situations within
each of these companies. One company is a close partner of Rambus and a leading RDRAM
producer. The other company is in the middle of a merger with NEC.

Enhanced Memory Systems intellectual property is focused on improving DRAM latency
independently of the DRAM interface so it is fully compatible with SDRAM, DDR, or Direct
Rambus and provides a performance edge for all of these memories.
