| Varian's legal troubles continue with this opposition to their latest motion for summary judgment: 
 "...At no time did I understand, believe, or agree to giving up any of my non-employment claims. What I understand I was releasing was my right to bring a wrongful termination or discrimination claim against Varian. At no time did anyone at Varian ever disclose to me that for a five week period they had secretly videotaped me going to, in, and from the men's bathroom at Varian. I had no reason to ever suspect Varian had engaged in such invasive actions against me. It was not until this lawsuit surfaced, and I took the deposition of Jane Crisler, that she spilled the beans by disclosing the existence of this secret videotaping. Not only did I never contemplate that such activities were taking place at Varian, but if I had, I certainly would never have agreed to any release of Varian, and I don't believe I ever did release Varian from such illegal acts by my signing the separation agreement. Even though my attorney has demanded plaintiffs to produce those videotapes, plaintiffs have refused to do so, stating that they are "missing", but somehow plaintiffs have produce six (approx.) black and white photos purportedly taken from those videos, including one that showed me inside the bathroom. ..."
