I think this is a big part of the reason BMCS powered ahead today. Kinda silly really, cuz these stupid law suits are essentially meaningless anyway. -John www2.marketwatch.com Monday, July 31, 2000 BMCS wins lawsuit dismissal --1:07 pm - By Chris Kraeuter BMC Software (BMCS: news, msgs) shares are up 8.6 percent. A U.S. District Court dismissed a class action lawsuit against the company and current and former officers alleging improper accounting treatment in connection with BMC's purchase of BGS Inc. According to a BMC statement, the plaintiffs will not appeal. There are currently two other class action suits pending and today's ruling does not apply to the other cases. BMC shares are up 1 7/16 to 18 13/16.
