Tom did not get a engineering sample. He posted on his website a picture of the CPU markings which indicate that it is a production part. Kyle's was too. If the actual mechanism that would change a 1133 part to a slower part does not get accelerated during the Q/C tests for lifetime, the model Intel uses to determine failure rate may not be any good for this purpose. Remember that it slows the processor, but it still works. The new stepping has not been out long. They already require BIOS changes to support the chip and the voltage markings were clearly wrong as the marking states 1.75V but the CPU requested 1.80V on the VID pins. This type of problem, bin failure, may not be tested for by Intel. Thus, it may not be able to be found in the short amount of time Intel had to test.

Now Intel may hope that the burn in by OEMs will cause all affected chips to fail a test somehow. But, if 5 to 10% of the shipped computers fail within a month or two, any OEM, be it IBM or Dell, will have a very costly field replacement bill. And all concerned will get an extremely large hit to their reputation. This is why I appreciate the time AMD is taking to validate the 1100 MHz Tbird.

Hopefully this is merely a glitch. If it is not, Intel is in for some heavy costs to the bottom line, and its reputation.
