KLH,

I am 110% for freedom of speech and I hate these lawsuits, but the lying and cheating and scares tactics on these boards has went well beyond any such realm of responsible discussion. They have in many cases degraded into tools to be used by those who wish to deceive or aggressively push an agenda for profit. I read some of those posts, I can see why the company is winning in court.

The danger though is when companies use such means to silence critics or those critical of their performance or that of managements. I surely hope that if people stick to facts, express opinions on performance, and/or generally just complain that they will have all the freedom of speech protection.

But when they cross the line, and start for example posting "bankruptcy" as fact, or suggesting "frauds" here or there, or get into the personal life of management(compensation excluded); then it is time for companies to silence them. Because it can quickly become detrimental to the company's shareholders if the deceit persists.

All around it is scary though. For example, Think of the times we questioned managements every move right here? Did you ever say anything that could get you in hot water? I don't think we did. We disagreed with their performance, but we did so responsibly. But you never know. You just never know.

CNC will be the next place you hear about such a lawsuit, in my opinion of course.
